SERVICE COMMITMENT
TCS warrants any French Drains installed from the date of our installation for a total of twenty(20) years against any defects in material or workmanship that result in the permeation of water through the base of the foundation where the drain was installed. This warranty is void in cases where the installed membrane has been damaged or compromised, intentionally or othewise, by you or other causes.
TCS warrants all of the above services according to the scope set in reaction to symptoms that have been provided by you throughout our points of contact and validated by our estimator(s). It is our job to gauge the threat of permeation and appropriately set this scope in response to provide you the most effective and cost-efficient solution to address your individual situation. Due to the migratory nature of draining water, there remains a chance that a new point of permeation may become affected. If your basement’s perimeter in its entirety has not been treated, we cannot guarantee that future work at additional cost may be necessary to extend the scope of your home’s protection.
This warranty does not imply indemnity for any tangible or intangible damage caused by leaking water itself; we do not provide compensation for any damages to person, property, or otherwise in relation to or caused by flooding, regardless of the water’s source of permeation, treated by us or otherwise.
We are not be held responsible for incidental damage related to our technicians’ work within our quoted work area, such as peeled paint or settled dust created from work performed. Additional ensuing cosmetic damage to concrete such as discolouration or efflorescence as a result of future leakage is also outside of our coverage scope.
In the case of any exterior excavation, window well installation, or window well service, within ninety(90) days of the work completed, you are entitled to one(1) free regrading upon settling of the quoted work area After this summary regrading, we are not responsible for any further settlement that may occur.
The foregoing warranties are the only warranties provided by the Crack Specialists Limited and there are no other warranties, express or implied, with respect to any work, services, or products supplied by The Crack Specialists Limited. To the extent permitted by law, any implied warranties provided for in any statute or legislation are specifically excluded. The liability of the Crack Specialists Limited for any breach of warranty or for any damages of any kind relating to any work, services or materials supplied by The Crack Specialists Limited shall be limited to a refund of any money paid by the client to the Crack Specialists Limited and The Crack Specialists Limited shall not be responsible for, or liable for, any other losses, damages or claims of every nature and kind whether same are foreseeable or otherwise.
